 We're gonna turn out to that deadly outbreak of Listeria that’s been linked to contaminated cantaloupes. One family impacted is now fighting back, demanding answers. But how these all could have happened? And with answer to that question, ABC's Jim Avila is with us this morning. Good morning, Jim.

 
Good morning, John. It's a phrase we hope never to hear: killer cantaloupes. And the dangers even fatal breakout of listeria is linked not to fruit cut up at the grocery store, it's from whole unpeeled fruit. Safeway and Wal-Mart are among the stores pulling the affected melons from their shelves. And one Colorado family is already suing the grower and the store where they bought the melon.
 
It's pure hell.
 
Tammy Palmer's husband Charles was rushed into the hospital two weeks ago, paralyzed, unable to speak.
 
I went over and started patting his face. And I'm like chuck what's wrong? And he….from shelves. But that’s not enough for the Palmers. They're the first to fight a lawsuit against Jensen farms, claiming that the cantaloupe they bought at the local Wal-Mart and supplied by Jensen farms tested positive for Listeria.
 
You don't know what to trust, what to buy. I just can't believe it. I'm just, I'm so in shock.
 
Charles Palmer remains in serious condition at the hospital. It has a long recovery ahead of him.
 
I want him home. I want him by my side.
 
So what have we learned from this? Scrub even fruit with rind or peel, cantaloupes are especially good at hiding bacteria because of the nooks and crannies in their skin. The melons in question come from that specific grower as which is among the largest in the country, Jensen Farm. So that's the label you would look for the store. Other cantaloupes are not affected. Neither Wal-Mart nor the grower responded to the lawsuit.
