Those legal opinions cut along party lines. Republican witnesses, like professor Elizabeth Price Foley, argue the House can sue President Obama for failing to faithfully execute the healthcare law–

Foley: "And I also believe the House would have an excellent chance of winning on the merits of the claim."

Clinton administration attorney Walter Dellinger say the House cannot, on its own, sue the President for routine legislative delays.

Dellinger: "If we were to start down that road, the President could go into court and sue the Senate for failing to give him an up or down answer on nominees."

While Republicans complain of an imperial Presidency, Democrats dismiss any potential lawsuit as a political stunt.
