 1. U.S. Airways and American Airlines say they will use all legal options to fight back against a challenges to their merger plans. The Justice Department joined a half dozen states in filing a lawsuit to block the merger in federal court, saying it would lead to higher fares and fees.

3. A police report says witnesses didn't see anyone else standing near an Atlanta Braves fan when he fell to his death at the team's stadium. Ronald Lee Homer Jr. fell about 65 feet on Monday night from a fourth-level smoking area into a parking lot.
4. And Coca-Cola plans to ran its first ad defending the safety of artificial sweeteners. The company wants to stem declining sales of diet soda. The print ad stresses the evidence showing the safety of aspartame, commonly known by the NutraSweet name.
