Cambodian Senate Passes Draft Law on Genocide Tribunal

The Cambodian Senate has 1)unanimously passed a draft law to create a genocide tribunal to try leaders of the former Khmer Rouge1, clearing the final 2)legislative 3)hurdle. It could still be a while before Cambodians see justice for the nearly two million people believed killed during the 4)regime's rule in the late 1970s.
Cambodia's 51 5)senators unanimously voted Monday to approve legislation that would allow the government to go ahead with long-awaited trials of senior leaders of the Khmer Rouge.
U.N. representatives brokered2 a deal last year to set up a joint3 6)tribunal 7)comprised of U.N. and Cambodian judges and 8)prosecutors. Both houses of Parliament approved the draft law earlier this year, but it had to be revised after the Constitutional Council had a problem with the penalty 9)provisions. The new version of the law 10)specifies that life imprisonment4 is the harshest punishment for those found guilty by the 11)genocide tribunal.
The law must now be again reviewed by the Constitutional Council and then signed by King Norodom Sihanouk. This could be completed by the end of August. Then the government and the United Nations will need to sign a deal to proceed.
U.N. officials have been critical of the time it has taken Phnom Penh to act and say they will only sign off on the tribunal if international standards of justice are met.
Senior cabinet minister, Sok An, who brokered the deal with the United Nations last year, is confident there will be no problems. "After the king signs it, then we are going to negotiate with the United Nations very actively5 on it. Not long after we sign an agreement with the U.N. will the court form and the trial process begin. We have to talk about the schedule, but if we can have an agreement fast, then we also can establish a trial quickly." The Khmer Rouge Maoist movement took power in 1975 and set about trying to create an 12)agrarian 13)utopia in Cambodia. Some 1.7 million people are believed to have been executed, 14)tortured, starved and died of disease in the four years the Khmer Rouge governed.
Decades later, the issue is extremely sensitive for the country, where many of the former Khmer Rouge leaders live freely after surrendering to the government. A number of former Khmer Rouge members hold positions in the government, including Prime Minister Hun Sen.
The prime minister has warned that the justice process must be handled carefully if Cambodia wants to protect its new found peace after decades of bloody6 conflict.
