The South Korean company has appealed a nearly $400 million judgment² for illegal copying patented aspects of the iPhone's aesthetic³.

Samsung added that none of the devices related to the ruling remain on the market.

The company's appeal also argues for the Supreme Court that a lower-court's ruling was over protective of Apple's patents and applied⁴ far too much compensation.

Samsung has already paid the sum, but seeks a refund⁵ should the nation's highest court rule in their favor.

The Supreme Court could decide early next year whether to hear the case, but arguments would not take place before the fall of 2016.
